1 - Purpose

These General Terms and Conditions of Sale (GTC) govern sales made on the "Carole Art Co" online store, accessible via the Shopify platform.

The store offers for sale:

  • downloadable digital posters (digital products)
  • printed posters sent by post in France

Any order placed on the store implies full and unreserved acceptance of these GTC.


2 - Products

The products offered are original artistic creations protected by copyright and belonging to Carole Courtoux.


Two types of products are available:

  • Digital products
    Digital posters downloadable after purchase.
    The customer receives a digital file for personal printing.


  • Physical products
    Posters printed and shipped by post in a protective tube.
    The photographs and visuals presented on the store are as faithful as possible but cannot guarantee a perfect match with the final product (especially concerning colors depending on screens or prints).


3 - Intellectual property

All works, images, illustrations, digital files and content sold or presented on the "Carole Art Co" store are protected by copyright. © Carole Courtoux – All rights reserved.


The purchase of a product, whether digital or physical, does not entail any transfer of intellectual property rights.


The files and works remain the exclusive property of Carole Courtoux. Any unauthorized use constitutes a copyright infringement and may be subject to legal proceedings in accordance with intellectual property legislation. 

The "Carole Art Co" store reserves the right to take any necessary action in case of fraudulent use or illegal distribution of the works.

This means that:


Authorized use

  • printing the file for personal use
  • private use in a non-commercial context


Prohibited use

  • resale of the digital file
  • sharing the file with third parties
  • free or paid distribution
  • commercial use
  • reproduction or modification for the purpose of selling or redistributing the work
  • use for derivative products


4 - Price

Prices are indicated in euros (€).

Digital products
The price corresponds to the purchase of the downloadable digital file.

Physical products
The price corresponds to the printed poster.


Delivery fees
Shipping costs are calculated based on:

  • the weight of the product
  • the current postal rate
  • the chosen shipping method

Delivery costs are indicated before order validation. SHIPPING ONLY IN FRANCE for logistical reasons.


5 - Order

Any order placed on the store implies acceptance of these GTC.

Once payment is validated, the order is considered firm and definitive.

The seller reserves the right to cancel or refuse an order in case of a dispute with a customer concerning a previous order.


6 - Digital products – Download

After payment validation, the customer receives a link to download the digital file.


Due to the digital nature of the product:

  • no returns are possible
  • no exchanges are possible
  • no refunds are possible

once the download has been made or made accessible.

The customer is responsible for downloading and backing up their file.


7 - Physical products – Delivery

Printed posters are shipped only in France.

Products are carefully packaged and sent in a protective tube to ensure their transport in the best conditions.

Delivery times depend on postal services and cannot be guaranteed.

The seller cannot be held responsible for delivery delays attributable to the carrier.

In case of a damaged package upon receipt, the customer must immediately notify the carrier.


8 - Right of withdrawal

In accordance with article L221-28 of the Consumer Code, the right of withdrawal does not apply to digital content supplied on an intangible medium where performance has begun with the consumer's prior agreement.

Therefore, downloaded digital products cannot be refunded.

For physical products, the customer has a legal period of 14 days after receipt to exercise their right of withdrawal, provided that the product is returned in perfect condition.

Return shipping costs are borne by the customer.


9 - Liability

The seller cannot be held responsible for:

  • improper use of the digital file
  • poor print quality related to the equipment or service provider chosen by the customer
  • a delay or delivery problem attributable to the carrier
  • a technical problem independent of the store (internet connection, Shopify platform, etc.)

10 - Personal data

Personal information collected during the order is used only for order management and customer relations.

It is neither resold nor transmitted to third parties, except for delivery or payment processing.


11 - Applicable law

These GTC are governed by French law.

In case of dispute, an amicable solution will be sought before any legal action.

Failing agreement, only French courts will have jurisdiction.

13 - Commercial exploitation of works

The works offered on the "Carole Art Co" store are protected by copyright and remain the exclusive property of their creator. © Carole Courtoux – All rights reserved.

The purchase of a product from the store, whether digital or physical, grants only a right of personal and private use. No commercial exploitation rights are transferred to the customer.

Any use of the works for commercial, professional or promotional purposes is strictly prohibited without prior written authorization.

This includes in particular:

  • reproduction of works on products intended for sale
  • use in advertising or marketing campaigns
  • integration into derivative products (textiles, stationery, decoration, objects, etc.)
  • use on commercial or promotional media
  • distribution or dissemination to third parties in a professional context

COLLABORATIONS & LICENSES

Carole Art Co's works may be subject to exploitation licenses for commercial projects.

Brands, companies, publishers or professionals wishing to use a work in the context of a project (publishing, derivative products, professional decoration, communication, etc.) can submit a collaboration request.

Each request is studied individually to define the conditions of use, the duration of the license and the remuneration.


Any company, brand, publisher, gallery or professional wishing to exploit a "Carole Art Co" work must imperatively request prior authorization.

A commercial exploitation license may be granted after studying the project. This license will be subject to a specific contract detailing the conditions of use, duration, territory and corresponding remuneration.
